This law applies to companies with 15 or more employees.<\/p>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">\u00a0<\/h2>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">SEXUAL HARASSMENT TRAINING\u00a0. . . .\u00a0<\/h2>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">It is a requirement for California\u00a0since 2005 for\u00a0employers to provide training sexual harassment\u00a0education\u00a0and provide employees\u00a0with the tools to prevent workplace harassment issues.This training ( 2 hrs. ),is required every two years for managers\u00a0working for employers with\u00a0<strong>50 or more employees<\/strong>\u00a0and\u00a0independent contractors.Starting in 2019\u00a0<strong>all employees<\/strong>\u00a0must receive preventive Harassment educational training.The training must take\u00a0place within 6 months of being hired. SB 1343 which passed in Ca., Oct. 2018, changes\u00a0 existing training laws, &amp; now requires\u00a0employers with five or more employees to provide non-supervisory employees with a minimum of one-hour of Harassment prevention training every two years, in addition to requiring employers to provide two hours of the bi-annual management training for sexual harassment and bullying.<\/p>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">\u00a0\u00a0\u00a0\u00a0<\/h2>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">DIFFERENT CATEGORIES OF\u00a0SEXUAL HARASSMENT IN CALIFORNIA\u00a0. . .\u00a0<\/h2>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Hostile work environment\u00a0. . . .\u00a0<\/h3>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Hostile work environment issues\u00a0occur when an employee is subjected\u00a0to frequent sexual comments, groping\u00a0or unwelcome conduct, of a persistent nature.\u00a0This may include off color\u00a0jokes,\u00a0offensive\u00a0computer material, groping, and social media\u00a0exploitation.\u00a0One time events or isolated\u00a0frequency,\u00a0does not\u00a0necessarily\u00a0count as sexual harassment. The\u00a0bottom\u00a0line is that the abusive actions\u00a0must be pervasive, frequent,\u00a0and unwanted.<\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Quid pro quo\u00a0. . . .\u00a0<\/h3>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\"><strong>Quid pro quo<\/strong>\u00a0typically occurs between a\u00a0owner, or\u00a0manager and the office employee. The manager may ask\u00a0the\u00a0hourly\u00a0employee\u00a0for sexual favors in exchange for employment benefits, such as promotions.\u00a0This most frequently\u00a0is between a person with business related leverage , or &#8220;power&#8221;, with a high level of influence, targeting and attempting to seduce ,or intimate\u00a0a lessor employee. The Hollywood movie environment would be a perfect example, of this power structure.<\/p>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">CALIFORNIA SEXUAL HARASSMENT\u00a0\u00a0LIABILITY\u00a0. . . .\u00a0<\/h2>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">Employees\u00a0owners,\u00a0or managers\u00a0can initiate\u00a0sexual harassment. If a workplace employee causes the sexual harassment, the employer will be held legally responsible,\u00a0if the manager\u00a0did not take\u00a0immediate and\u00a0appropriate action to remedy the situation.If the manager\u00a0causes the sexual harassment, the employer faces strict liability under California law.\u00a0\u00a0Title VII of the Civil Rights Act of 1964 allows the employer to escape liability if the following situations have occurred:<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>No tangible employment actions were taken against the victim;<\/li>\r\n<li>The employer\u00a0took reasonable and appropriate action\u00a0to prevent and correct the abusive behavior.<\/li>\r\n<li>The\u00a0victim, who had knowledge of the complaint process, and Ca. preventive training,\u00a0did not take advantage of the\u00a0complaint process and the\u00a0opportunities available to correct the situation.<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">\u00a0DAMAGES IN SEXUAL HARASSMENT CASES\u00a0. . . .<\/h2>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">In the perfect\u00a0workplace,\u00a0the\u00a0employer will take a harassment\u00a0claim seriously and work quickly to resolve it, which is certainly\u00a0in the companies best interest.However, if the\u00a0employer does nothing and the harassment continues, the environment may become so stressful, creating a &#8220;hostile work environment&#8221; , which multiplies the issues.The employee could easily\u00a0suffer\u00a0physical\u00a0discomfort, and mental anguish\u00a0from the harassment.\u00a0\u00a0It is quite possible that the employee\u00a0could recover damages from the harassment endured, such as mental anguish, job loss, and lost wages.\u00a0No employee should be afraid to come to work because of sexual harassment.\u00a0A workplace with a<strong>\u00a0&#8220;Zero Tolerance&#8221;<\/strong>\u00a0for abuses is the only solution.\u00a0If you are a victim of harassment, it&#8217;s\u00a0important that you inform your manager, so that the appropriate steps can be taken to remedy the situation
