Power to Cancel or Pause Immigration Documents<\/strong><\/h2><p><strong>What\u2019s Changing?<\/strong><\/p><p>It will provide the government with the authority to suspend, cancel, or modify immigration documents, such as visas, study or work permits, and eTAs, in the interest of the community.<\/p><p><strong>What\u2019s \u201cPublic Interest\u201d?<\/strong><\/p><p>This could include:<\/p><ol><li>National emergencies or disasters<\/li><li>Health or security threats<\/li><li>Large-scale fraud or misuse of programs<\/li><\/ol><p>The changes will not have any effect on asylum claims and will not cancel immigration status automatically- status decisions use current laws.<\/p><p><strong>Who Decides?<\/strong><\/p><p>These calls will be made by the Governor in Council of Canada (the Governor General, advised by Cabinet) based on an assessment of risks and impacts, in particular to vulnerable people.<\/p><h2><strong>2. Easier Information Sharing Across Canada<\/strong><\/h2><p><strong>What\u2019s Changing?<\/strong><\/p><p>Immigration, Refugees and Citizenship Canada (IRCC) will be able to <strong>share applicant data<\/strong> more efficiently with:<\/p><ol><li>Federal and provincial governments<\/li><li>Territorial partners<\/li><\/ol><p><strong>Why?<\/strong><\/p><p>To improve service delivery and reduce fraud. This means faster help for newcomers and less red tape.<\/p><p><strong>Privacy Still Matters:<\/strong><\/p><ol><li>Sharing will follow Canada\u2019s <strong>Privacy Act<\/strong><\/li><li>Data can\u2019t be shared with foreign governments unless clearly approved<\/li><li>Only partners with a legal need can receive the information<\/li><\/ol><h2><strong>3. New Asylum Ineligibility Rules<\/strong><\/h2><p>To prevent misuse of asylum rules, the Act introduces <strong>two new limits<\/strong>:<\/p><h4><strong>1-Year Rule<\/strong><\/h4><p>Claims filed <strong>over 1 year<\/strong> after arriving in Canada (after June 24, 2020) won\u2019t go to the IRB. This applies to <strong>all individuals<\/strong>, including students and workers.<\/p><h4><strong>14-Day Rule for Irregular Crossings<\/strong><\/h4><p>If someone enters Canada <strong>irregularly<\/strong> and doesn\u2019t file an asylum claim within <strong>14 days<\/strong>, the claim won\u2019t go to the IRB.<\/p><p>These rules apply to all claims <strong>on or after June 3, 2025<\/strong>, if the bill is passed.<\/p><p><strong>Still a Path to Protection:<\/strong><\/p><p>People ruled ineligible can apply for a <strong>Pre-Removal Risk Assessment (PRRA)<\/strong>, which can still result in refugee protection if serious risks exist.<\/p><h2><strong>What\u2019s Next?<\/strong><\/h2><p>The Strong Borders Act is not yet law\u2014it\u2019s still awaiting final approval.
